Virginia’s Premarital Agreement Act, codified at Chapter 8 of Title 20 of the Code of Virginia, governs any premarital agreement signed on or after July 1, 1986. Under Va. Code § 20-150, parties can contract with respect to a broad set of financial matters. Understanding the scope helps couples decide what to include.

A court can refuse to enforce a premarital agreement if there is clear and convincing evidence it wasn’t executed voluntarily, or if it was unconscionable at the time of signing and the challenging party wasn’t given fair and reasonable disclosure of the other party’s property and financial obligations.
